Terms of Use

1. Purpose and Scope

This web portal (Comunidad Lomas 2, hereinafter "the Portal") is an internal information and management service made available exclusively to authorised residents of the Comunidad de Propietarios Lomas 2 del Higuerón.

Accessing and using the Portal implies full and unconditional acceptance of these Terms of Use. If you do not agree, you must refrain from accessing or using the Portal.

2. Access and Access Control

Access to the Portal is restricted to registered residents. To access:

You request access by entering your email address on the Portal's sign-in page.
If your email is not yet in the community, you must register by providing your details (name, home or homes, and your relationship to each one). The President, an administrator, or a vice-president reviews and approves each request manually.
Once your email is authorised, you receive a single-use code (or a magic link) in your email to complete sign-in. Alternatively, you can sign in with "Sign in with Google" using your authorised email account.
Your session remains active for 30 days after each sign-in; after this period, you must sign in again.

The community President reserves the right to suspend or revoke access at any time, especially if the resident is no longer part of the community or misuses the Portal.

3. Acceptable Use

By accessing the Portal, you agree to:

Use the Portal exclusively for purposes related to the management and information of the homeowners' association.
Not share your access credentials (code or magic link) with third parties.
Not attempt to access sections or data for which you are not authorised.
Not perform any actions that could damage, disable, overload, or impair the Portal or its systems.
Not use the Portal to spread false, offensive, or rights-infringing information.

4. User-Generated Content

The Portal includes features in which residents create content: roadmap ideas, comments, incidents, survey votes and responses, bookings, guest-stay notices, and file attachments, among others. In respect of that content, you agree that:

You are responsible for the content you post and warrant that you have the right to share it.
You will not post unlawful, offensive, defamatory content, or content that infringes third-party rights.
You will not post third parties' personal data without their consent. In particular, when announcing guest stays, do not include personal data of the people staying.
You grant the community a non-exclusive licence to display and retain that content within the Portal for community-management purposes.

The community may moderate, edit, or remove content that breaches these rules.

5. AI Assistant

The Portal may offer an artificial-intelligence assistant for informational purposes. Its answers are generated automatically and may contain errors or inaccuracies, so they should not be treated as official community advice; always verify relevant information through official channels. Do not enter third parties' personal data or sensitive information in your queries to the assistant (see the Privacy Policy).

6. Activity Logging

For security and audit purposes, the Portal records the activity of authenticated users (actions performed, pages visited, date and time). This log is for the community's internal use; its scope is detailed in the Privacy Policy.

7. Portal Content

The information published on the Portal is for informational and internal use only. The Comunidad de Propietarios Lomas 2 del Higuerón does not guarantee the accuracy, completeness, or currency of all content at all times.

Documents, financial data, and other information available on the Portal are for the exclusive use of community residents and may not be reproduced, distributed, or published outside this context without prior authorisation.

8. Downloadable Files

Files available for download through the Portal (hosted on Google Drive) are internal community documents. Their download and use are subject to the same restrictions as in the section above.

9. Intellectual Property

The design, source code, logos, and texts of the Portal are the property of the Comunidad de Propietarios Lomas 2 del Higuerón or its collaborators, and are protected by applicable intellectual property law. Total or partial reproduction without express authorisation is prohibited.

10. Service Availability

The Portal is provided "as-is" with no guarantee of continuous availability. The Portal may be served through a shared subdomain or through the community's own domain; in both cases, access is managed securely. The community reserves the right to:

Temporarily interrupt the service for maintenance or technical reasons.
Modify, expand, or reduce the Portal's functionality at any time.
Discontinue the service with reasonable prior notice to residents.

11. Limitation of Liability

The Comunidad de Propietarios Lomas 2 del Higuerón shall not be liable for:

Damages arising from misuse of the Portal by a resident.
Loss or corruption of data caused by external factors (third-party failures, cyberattacks, etc.).
Service interruptions due to force majeure.

12. Applicable Law and Jurisdiction

These Terms of Use are governed by Spanish law. For any dispute arising from the use of the Portal, the parties submit to the competent courts of the registered address of the Comunidad de Propietarios Lomas 2 del Higuerón, expressly waiving any other jurisdiction that may apply.
